Terms of Service

Payment

HyperWebservers.com/Computer Central LLC provides our clients multiple payment methods for convenience. Some of these methods include Paypal®, Credit Card (AMEX, Master Card, Visa, and Discover), Cash, and Check. You are required when opening an account to provide HyperWebservers.com/Computer Central LLC with proper billing information and keep continually accurate information through the use of an active HyperWebservers.com/Computer Central LLC account. However, in the event of a charge-back or returned check, the client will be responsible for the following:
1. All charge backs or returned or bounced checks will warrant a $50 fee or the maximum allowed by law, whatever is greater.
2. You will have 5 days to correct the information and make proper payment for your service. HyperWebservers.com/Computer Central LLC however, reserves the right to suspend or terminate your account until billing information is corrected. Please remember, all payments to HyperWebservers.com/Computer Central LLC are non-refundable.

Billing Period

Billing periods are based on one month (whether it is 29 days, 30 days, ext.), however we do offer 3 and 6 and 12 month pay periods. All invoices are due on the date stated on the invoice. If payment is not received on the first, we reserve the right to suspend or terminate any HyperWebservers.com/Computer Central LLC account. On some hosting plans (dedicated, shared, or other), there may be a 30 day or more grace period. A grace period will be handled on a case by case basis. Late payments are subject to a $10 late fee.

Disconnection

HyperWebservers.com/Computer Central LLC reserves the right to suspend or terminate any account at any time, for any reason, with or without notice. All disconnections, suspensions, or terminations are subject to a $50 reconnect fee.

Cancellation

Cancellation of your HyperWebservers.com/Computer Central LLC requires a notice received at least 20 days before the renew date. If a cancellation notice is received with less than 20 days before the renew date, HyperWebservers.com/Computer Central LLC will put you into a cancellation queue for next month. Your account will continue to be billed accordingly for the next month.

Liability

You agree to indemnify and hold harmless HyperWebservers.com/Computer Central LLC and the employees and agents of Company (each an "Indemnified Party") against any losses, claims, damages, liabilities, penalties, actions, proceedings or judgments (collectively, "Losses") to which an Indemnified Party may become subject and which Losses arise out of, or relate to this Agreement or Customer’s use of the Services and Products, and will reimburse an Indemnified Party for all legal and other expenses, including reasonable attorneys’ fees incurred by such Indemnified Party in connection with investigating, defending or settling any Loss whether or not in connection with pending or threatened litigation in which such Indemnified Party is a party. HyperWebservers.com/Computer Central LLC shall not be liable for (i) any indirect, incidental, special or consequential damages, or for any loss of profits or loss of revenue resulting from the use of the company’s services and products by customer or any third parties, or (ii) any loss of data resulting from delays, nondeliveries, misdeliveries or service interruptions company provides the services and products as is, without warranty of any kind, whether express or implied company disclaims all implied warranties, including, but not limited to, the implied warranties of merchantability or fitness for a particular purpose customer shall be solely responsible for the selection, use and suitability of the services and products and company shall have no liability therefore.

Reservation of Termination

HyperWebservers.com/Computer Central LLC reserves the right to terminate or suspend any HyperWebservers.com/Computer Central LLC account at any time, with any reason, with or without notice.

Level of Service

HyperWebservers.com/Computer Central LLC does provide 99.9% uptime. However, we do not guarantee uptime of 99.9%. Reimbursement of funds for downtime is at HyperWebservers.com/Computer Central LLC sole discretion and is not obligated in any way to issue funds for downtime of any kind.
